Terms of Service

These Terms of Service (“Terms”) are a legal agreement between you and Clear Mint, Inc. (“Clear Mint”, “we”, “us”) governing your access to and use of clearmint.ca, the Clear Mint web application, and related services (the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. The Service

Clear Mint is a personal- and family-finance organization tool. It lets you record income, bills and expenses, budgets, goals, subscriptions, debts, assets, and investments; import bank and credit-card statements (OFX, QFX, CSV, PDF); optionally link financial institutions; reconcile balances; project cash flow; and view reports, insights, and AI-generated suggestions. The Service is a record-keeping and planning aid only.

2. Not financial, investment, tax, or legal advice

Clear Mint, including its AI features, debt-payoff plans, projections, and recommendations, is provided for informational and organizational purposes only. It is not financial, investment, tax, accounting, or legal advice, and we are not a bank, broker-dealer, investment adviser, or fiduciary. Figures may be estimated, incomplete, or inaccurate. Always verify with your financial institution and consult a qualified professional before making financial decisions. You are solely responsible for your decisions.

3. Eligibility

You must be at least the age of majority in your province or territory of residence and able to form a binding contract. You agree to provide accurate registration information and to keep it up to date.

4. Accounts & security

  • You are responsible for safeguarding your login credentials and for all activity under your account.
  • Notify us promptly at support@clearmint.ca if you suspect unauthorized access.
  • We offer an optional auto sign-out for inactivity; using it and keeping your devices secure is your responsibility.

5. Subscriptions, trials & billing

  • Plans — Clear Mint offers free and paid plans. Paid plans (for example, Premium and Essentials) are described at checkout, including price, billing interval, and any free-trial length.
  • Trials — where a free trial is offered, it converts to a paid subscription at the end of the trial unless you cancel before it ends. Trials may be limited to one per customer.
  • Auto-renewal — subscriptions renew automatically for the same interval at the then-current price until cancelled. You authorize us and our payment processor (Stripe) to charge your payment method on each renewal.
  • Cancellation — you can cancel at any time; cancellation stops future renewals and takes effect at the end of the current paid period. You retain access until then.
  • Refunds — except where required by law, payments are non-refundable and partial periods are not prorated.
  • Price changes — we may change prices or plan features; we will give notice and changes apply to the next billing cycle.
  • Taxes — prices may exclude applicable taxes, which you are responsible for.

6. Bank connections & imported data

Linking a financial institution is optional and is performed through our connectivity provider (Plaid). By linking an institution or importing a statement, you represent that you are authorized to access that data, and you authorize us to retrieve, store, and process it to provide the Service. We are not responsible for the availability, accuracy, or completeness of data provided by your institution or a third party.

7. Your data & its accuracy

You own the financial data you enter or import. You grant Clear Mint a limited licence to host, process, and display that data solely to operate and improve the Service for you, as described in our Privacy Policy. Automated parsing, categorization, recurring-item detection, reconciliation, and AI output may contain errors; you are responsible for reviewing and correcting your records.

8. Acceptable use

You agree not to: use the Service unlawfully or for anyone you are not authorized to act for; attempt to access another user’s data; reverse engineer, disrupt, overload, or probe the Service or its security; scrape or resell the Service; or upload malware or infringing content.

9. Third-party services

The Service relies on third parties (including Supabase, Vercel, Plaid, Stripe, Google/Groq AI, Resend, and logo.dev). Your use of features that depend on them may also be subject to their terms, and we are not responsible for their acts or omissions.

10. Intellectual property

The Service, including its software, design, and trademarks (such as the Clear Mint name and logo), is owned by Clear Mint and protected by law. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your personal, non-commercial use. All rights not expressly granted are reserved.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or that any data, calculation, projection, or AI output will be accurate or complete.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLEAR MINT AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR CAD $50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

13. Indemnification

You agree to indemnify and hold Clear Mint harmless from claims, damages, and expenses (including reasonable legal fees) arising from your misuse of the Service, your violation of these Terms, or your violation of any law or third-party right.

14. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you breach these Terms, if required for security or legal reasons, or if we discontinue the Service. Provisions that by their nature should survive termination (including ownership, disclaimers, and limitations of liability) will survive.

15. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-laws rules. The courts located in Ontario will have jurisdiction, subject to any mandatory consumer-protection rights you have where you live.

16. Changes to these Terms

We may update these Terms from time to time. We will revise the “Last updated” date and, for material changes, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance.
